Affiliate terms

The terms that apply to everyone who promotes licensed South African operators through YouBet Partners. Please read them before you sign up.

Version: v2.0 — effective 22 October 2026

How to read these Terms

These Terms are a legally binding agreement between you and us. We have tried to write them in plain English. Headings and the "In short" boxes are only there to help you read. They do not change the meaning of the clauses.

In short: By ticking the box when you sign up, you agree to everything below. Read it before you tick.

1. Definitions

In these Terms:

1.1 "We", "us", "our" or "YouBet Partners" means Corvanta Media Group Ltd, trading as YouBet Partners, operating the website youbetaff.com.

1.2 "You" or "Promoter" means the person or company whose application to join the Programme we have approved.

1.3 "Programme" means the YouBet Partners promoter programme described in these Terms.

1.4 "Operator" means a gambling operator that holds a valid South African provincial gambling licence and with which we have an affiliate agreement. The current list of Operators is shown in your Promoter Dashboard.

1.5 "Operator Terms" means the affiliate terms, marketing rules, brand guidelines and any other requirements that an Operator applies to us. Where they apply to you, we will email you the relevant parts when we approve your application and whenever we add an Operator to your account or the Operator changes them.

1.6 "Promoter Dashboard" means your online account on our tracking platform (currently Scaleo, or any replacement platform we tell you about).

1.7 "Tracking Link" means the unique link, code or promo code we give you to identify the Players you refer.

1.8 "Player" means a person who opens an account with an Operator through your Tracking Link and whom the Operator links to us in its own reporting.

1.9 "Qualifying Player" means a Player who meets all the conditions in clause 3.6.

1.10 "Gross Gaming Revenue" (GGR) means the total amount staked by your Players with an Operator, less winnings paid to them, for the relevant period, as reported by the Operator.

1.11 "Net Gaming Revenue" (NGR) means GGR less the following, as reported by the Operator for your Players:
(a) bonuses, free bets and other promotional costs;
(b) gambling taxes and levies;
(c) payment processing costs, chargebacks and reversed transactions;
(d) losses from fraud, bonus abuse and bad debt;
(e) any platform, licence, provider or other fees that the Operator deducts from us under the Operator Terms.

1.12 "Commission" means the amount you earn under clause 3.

1.13 "Commission Schedule" means the page in your Promoter Dashboard (or a document we send you) that shows, for each Operator, the commission model and rates that apply to you, the payment date for that Operator, and the products approved for promotion (clause 6.3.10).

1.14 "Operator Payment" means money that an Operator has actually paid into our bank account for the period and Players concerned.

1.15 "Month" means a calendar month.

1.16 "Marketing Material" means any advert, post, video, live stream, story, message, banner, landing page, group description or other content that promotes an Operator or contains a Tracking Link.

1.17 "Applicable Law" means all laws and binding codes in South Africa that apply to you or to the promotion of gambling. This includes the National Gambling Act 7 of 2004, provincial gambling laws and rules, the Lotteries Act 57 of 1997, the Protection of Personal Information Act 4 of 2013 (POPIA), the Consumer Protection Act 68 of 2008 (CPA), the Electronic Communications and Transactions Act 25 of 2002 (ECT Act), the Financial Intelligence Centre Act 38 of 2001 (FICA), tax laws, and the Code of Advertising Practice of the Advertising Regulatory Board (ARB), including its Gambling Appendix.

1.18 "Excluded Person" means a person who is under 18, a person on a national or provincial register of excluded persons, or a person who has self-excluded with an Operator.

1.19 "business day" means Monday to Friday, excluding public holidays in South Africa.

2. Eligibility and Registration

In short: You must be 18+, give us true details, pass our checks, have only one account, and not work for an Operator. You cannot recruit your own sub-promoters.

2.1 How the agreement starts. You apply by completing the sign-up form on youbetaff.com or our tracking platform and ticking the box to accept these Terms. The agreement starts only when we email you to say that we have approved your application. We may reject any application without giving a reason. We aim to review applications within 1–2 business days. This is a target, not a guarantee: a review may take longer, for example if we need more information from you. The KYC checks in clause 2.4 are separate.

2.2 Age. You must be at least 18 years old. If you are a company, every director and every person who will create Marketing Material for you must be at least 18. Any person who appears in or presents your Marketing Material must also be at least 18, or older if the Operator Terms require it.

2.3 True information. All information you give us must be true, complete and kept up to date. Tell us within 7 days if any of it changes, including your payment details, the channels you use, or who owns or controls your company.

2.4 Know-your-customer (KYC) checks. Before we pay you, and at any time after that, we may ask for:
(a) individuals: a South African ID document or passport, and proof of address not older than 3 months;
(b) companies: registration documents, ID and proof of address of the directors and of anyone owning 25% or more, and a company letterhead;
(c) if you choose to be paid into a Skrill, Neteller or PayPal account, proof that the account is in your own name or your company's name (not needed for voucher payments);
(d) your tax number and, if you are VAT-registered, your VAT number; and
(e) a list of all channels, pages, groups and websites you will use.
We may hold back payments until you give us these documents and we have checked them. If you do not provide them within 30 days of our request, we may end the agreement under clause 11.

2.5 Who cannot join. You cannot join, and must tell us immediately if you become any of the following:
(a) an employee, director, contractor or agent of an Operator or of us;
(b) a spouse, partner, parent, child or sibling of, or someone living in the same household as, a person in (a);
(c) an Excluded Person; or
(d) a person who has previously been removed from our Programme or from any Operator's affiliate programme for breaking the rules.

2.6 One account only. You may hold only one Promoter account. Accounts that we reasonably believe are controlled by the same person or household, or share the same bank or wallet account, email address, ID, device or payment details, count as one account. We may close duplicate accounts and treat any Commission earned through them as forfeited under clause 8.

2.7 No sub-promoters. You must promote Operators yourself. You may not:
(a) recruit, appoint or pay other people to promote using your Tracking Links;
(b) run a sub-affiliate network or give your Tracking Links to others to use; or
(c) sell, transfer, rent or share your account.
Your employees may help you if you tell us who they are in advance, and you are fully responsible for everything they do.

2.8 Your own status. You are an independent contractor. Nothing in these Terms makes you our employee, partner, joint-venture partner or agent. You may not make promises or sign anything on our behalf or on behalf of any Operator.

3. Commission Structure

In short: You earn 70% of what the Operator pays us for your Players, as shown in your Commission Schedule. Losses in one month do not reduce what you earn in the next month (no negative carryover), unless the Operator itself carries them over to us.

3.1 Commission models. For each Operator, your Commission Schedule will show one of these models:
(a) Revenue Share (RevShare): a percentage of the NGR from your Qualifying Players;
(b) Cost Per Acquisition (CPA): a fixed one-time amount for each Qualifying Player; or
(c) Hybrid: a smaller fixed amount for each Qualifying Player plus a smaller percentage of NGR.
You earn only one model for each Player at a time.

3.2 Rates. Your rates are those shown in your Commission Schedule from time to time. The default rates are:

  • RevShare: 70% of the RevShare rate that the Operator pays us for the same Players. For example, if the Operator pays us 30% of NGR, your rate is 21% of NGR.
  • CPA: 70% of the CPA amount that the Operator pays us for the same Qualifying Player.
  • Hybrid (only where the Operator pays us on a Hybrid basis): 70% of the fixed amount and 70% of the NGR percentage that the Operator pays us.

We may change your rates under clause 13. Clause 13.4 explains how a reduction applies.

3.3 How RevShare is calculated. For each Month and each Operator: RevShare Commission = NGR of your Qualifying Players × your RevShare rate. We use the NGR figures that the Operator reports to us. If the Operator does not report NGR per Promoter, we will divide it fairly based on the Player data the Operator gives us.

3.4 No extra admin fee. We do not charge you any admin fee of our own. The only deductions from GGR are those listed in clause 1.11, which the Operator applies.

3.5 No negative carryover. If the NGR of your Qualifying Players for an Operator is negative in a Month, your RevShare Commission for that Operator for that Month is zero. The negative amount is not carried forward to reduce your Commission in later Months. Exceptions:
(a) if the Operator Terms allow the Operator to carry forward losses against us (for example for "high roller" Players, or in general), the same carryover applies to your Players and your Commission in the same way (see clause 4); and
(b) negative amounts caused by fraud, bonus abuse or a breach of these Terms may always be set off against any Commission owed to you.

3.6 Qualifying Player. A Player is a Qualifying Player only if all of the following apply:
(a) the Player is new to the Operator and opened the account through your Tracking Link;
(b) the Player is at least 18, is located in South Africa and is not an Excluded Person;
(c) the Player passes the Operator's identity (KYC) checks;
(d) for CPA and Hybrid: the Player meets the minimum deposit, wagering and time conditions that the Operator applies to us for that Player, as shown in your Commission Schedule;
(e) the Operator accepts the Player as a qualifying player under the Operator Terms and pays us for that Player; and
(f) the Player was not referred in breach of these Terms.

3.7 Duration of RevShare. You earn RevShare on a Qualifying Player for as long as both (a) the agreement between you and us continues and (b) the Operator pays us for that Player, unless your Commission Schedule states a shorter period.

3.8 Our records decide. Commission is calculated using the Operator's reports and our tracking platform records. If they differ, the Operator's reports prevail, because that is what we are paid on. We are not responsible for tracking failures caused by you or by Players' devices (for example, if you change or shorten Tracking Links, or if Players use ad-blockers or clear cookies). Clicks and registrations normally appear in your Promoter Dashboard in real time. Click and registration figures in your Promoter Dashboard are for information only: they may be delayed, corrected or reversed, and they do not change how Commission is calculated under this clause.

3.9 Inactive accounts. If you refer no Qualifying Player for 3 consecutive Months, we may change your rate, suspend your account or end the agreement under clause 11.2. Before we do this, we will give you 30 days' notice (instead of the 14 days in clause 11.2).

4. Back-to-Back with Operators (Pay-When-Paid)

In short: We can only pay you out of money the Operators actually pay us. If an Operator refuses to pay, deducts money or claws money back for your Players, the same applies to you. Operator rules apply to you as well as ours.

4.1 Operator Terms apply to you. When you promote an Operator, you must follow both these Terms and the parts of the Operator Terms that we make available to you. If there is a conflict, the stricter rule applies. We may add Operator-specific rules to your Commission Schedule or Promoter Dashboard at any time, and they become part of these Terms from the date we tell you about them.

4.2 Pay-when-paid. Your Commission for an Operator becomes payable only after we have received the Operator Payment that covers your Players for that period, and only up to the amount the Operator has paid us for your Players. If an Operator pays us late, we will pay you on the next payment date for that Operator under clause 5.4 after we receive the payment. If an Operator pays us only part of what it owes, we will share the shortfall in proportion to what each Promoter's Players generated.

4.3 Operator non-payment. If an Operator does not pay us at all (for example because of insolvency, loss of licence, or a dispute), we will not owe you Commission for the unpaid amount. We will take reasonable steps to recover the money and pass on to you your proportional share of anything we recover, less reasonable collection costs.

4.4 Operator deductions and clawbacks pass through. If an Operator:
(a) refuses to count a Player as qualifying;
(b) reduces, withholds or reverses commission because of fraud, chargebacks, bonus abuse, high-roller rules, negative carryover, tax or any other reason allowed by the Operator Terms;
(c) claws back money it has already paid us; or
(d) changes the rate it pays us,
then the same reduction, withholding, reversal, clawback or rate change applies to the Commission for your Players. We may recover any clawback from your future Commission or ask you to repay it within 30 days of our request.

4.5 Operator disputes. If we are in a dispute with an Operator about your Players, we may hold the related Commission until the dispute is resolved. We will keep you informed of the progress.

4.6 Operator leaves the Programme. If an Operator ends its agreement with us or stops paying for existing Players, we will tell you as soon as reasonably possible. Your Commission for that Operator ends on the same date as the Operator's payments to us end. We will still pay Commission already covered by an Operator Payment.

4.7 Operator instructions. If an Operator asks us to make you remove, change or stop any Marketing Material or activity, you must do so within 24 hours of our request (or sooner if we or the Operator say it is urgent).

5. Payment Terms

In short: We pay in rand on each Operator's payment date shown in your Commission Schedule, to your Skrill, Neteller or PayPal account or by 1Voucher, OTT Voucher or Blu Voucher (PIN sent to your registered email), after the Operator pays us and once you reach R500. We prepare your invoice for you (VAT-registered Promoters send their own tax invoice). Query a statement within 30 days or it becomes final.

5.1 Currency. All Commission is calculated and paid in South African rand (ZAR). If an Operator pays us in another currency, we convert it at the rate our bank actually applied.

5.2 Monthly statement. By the 5th business day of each Month, we will publish a statement in your Promoter Dashboard showing your Commission for the previous Month and which amounts are still waiting for Operator Payment.

5.3 Invoice. After the statement is published, we prepare a self-billed invoice in your name for the payable amount and make it available in your Promoter account. You do not need to send us your own invoice, and you accept our self-billed invoice unless you dispute it under clause 5.9. If you are VAT-registered, you must instead issue us a valid tax invoice under the Value-Added Tax Act for the payable amount. Payable amounts for which a VAT-registered Promoter has not issued a valid tax invoice within 6 months of the statement are forfeited.

5.4 Payment date. Each Operator has its own payment date, shown in your Commission Schedule for that Operator. On that date we pay the Commission for that Operator for which we have received the Operator Payment and, if you are VAT-registered, your valid tax invoice, together with any amounts rolled over under clause 5.5, subject to clause 4.2 (pay-when-paid). Each such date is a "payment run" in these Terms. If a payment date is not a business day, we pay on the next business day.

5.5 Minimum payment and rollover. We pay only when your total payable Commission is at least R500. Payable Commission from all Operators is added together, and smaller amounts roll over to later payment runs until the total reaches the minimum. When the total reaches the minimum, we pay the whole payable amount on that payment run. If your account closes with a balance below the minimum, we will pay it out if you ask us within 90 days, after deducting any amounts you owe us.

5.6 Payment method. We pay into a Skrill, Neteller or PayPal account, or by 1Voucher, OTT Voucher or Blu Voucher. Wallet accounts must be in your name (or your company's name) and we must have verified them. We do not pay into third-party accounts. If you choose a voucher, we send the voucher PIN to the email address registered on your Promoter account.

5.7 Payment charges. All fees charged for payments into a Skrill, Neteller or PayPal account, and all fees for issuing a 1Voucher, OTT Voucher or Blu Voucher, are paid by you and deducted from the payment. Any currency conversion, intermediary or cross-border charges, including those applied by the wallet provider or voucher issuer, are paid by you and deducted from the payment.

5.8 Tax and VAT.
(a) You are responsible for declaring and paying all income tax and other taxes on your Commission.
(b) If your taxable supplies exceed R2,300,000 a year, you must register for VAT (threshold effective 1 April 2026, according to SARS). If you are VAT-registered, Commission is VAT-exclusive and we will pay VAT on top of it against a valid tax invoice. If you are not VAT-registered, Commission includes any VAT and you may not charge VAT. If you are not resident in South Africa, you may not charge South African VAT on your invoices; we will deal with any South African VAT on your services as the law requires.
(c) If the law requires us to withhold tax from any payment, we will do so and give you proof.

5.9 Statement disputes. If you think a statement is wrong, you must tell us in writing within 30 days of the statement date and explain why. We will reply within 30 days. If you do not dispute a statement in time, it becomes final, except for errors caused by fraud or by an Operator correction under clause 4.4.

5.10 Our errors. If we pay you too much by mistake, we may deduct the overpayment from future Commission or ask you to repay it within 30 days. If we pay you too little, we will pay the difference in the next payment run.

5.11 Set-off. We may deduct from your Commission any amount you owe us under these Terms, including clawbacks, penalties under clause 8, and costs under clause 12.

5.12 Unclaimed money. If we cannot pay you because your payment details (wallet account or registered email) are wrong or your KYC is incomplete, and you do not fix this within 6 months after we notify you, the unpaid Commission is forfeited.

6. Advertising and Marketing Standards

In short: Every promotion must show the 18+ and responsible-gambling warning. Never target children or self-excluded people, never promise wins, never spam, never pretend to be the Operator, and only promote licensed products. Some material needs our approval before you post it.

6.1 Mandatory warning on every piece of Marketing Material

6.1.1 Every piece of Marketing Material must show a responsible-gambling warning that includes at least:
(a) a statement that only persons aged 18 or older may gamble lawfully (for example "18+ only");
(b) the name of the National Responsible Gambling Programme (NRGP);
(c) the NRGP toll-free counselling number 0800 006 008; and
(d) the slogan prescribed or in use by the NRGP (at the date of these Terms, "Winners know when to stop").
Recommended wording: "18+ only. Winners know when to stop. National Responsible Gambling Programme: 0800 006 008 (toll-free, 24/7)."

6.1.2 Size and placement. The warning must be clear and easy to read:
(a) written material, posts, emails and messages: in a font at least as large as the main text;
(b) web pages, landing pages and banners: covering at least 10% of the page or banner;
(c) video, reels, stories and live streams: shown on screen in a legible format for at least 3 seconds, and for live streams on screen for the whole stream; and
(d) profiles, pages, groups and channels used to promote Operators: in the bio, "about" section or pinned post.
Items (a) for email, (b) for the home page of a website, and the 3-second rule in (c) follow the ARB Gambling Appendix, clauses 4.2, 4.3 and 4.6. The other requirements in this clause are stricter rules of this Programme.

6.1.3 Where Operator Terms or Applicable Law require more (for example the Operator's licence number or a link to its terms), you must include that as well.

6.2 Responsible gambling

6.2.1 Your Marketing Material must present gambling as entertainment for adults, not as a way to make money.

6.2.2 You must include a link to, or the contact details of, the NRGP on every website, landing page, group or channel you use to promote Operators.

6.2.3 If a person tells you they have a gambling problem, you must not encourage them to gamble and must refer them to the NRGP.

6.3 Prohibited content and conduct

You must not, directly or indirectly:

6.3.1 Minors: target, appeal to or attract people under 18. This includes using cartoon characters, people who are or look under 18, school or youth themes, or placing material in media, venues or channels aimed mainly at people under 18, or near schools, youth centres or campuses.

6.3.2 Excluded Persons: target or contact Excluded Persons, or encourage anyone to remove themselves from an exclusion register or reverse a self-exclusion. You must not buy keywords or create content aimed at self-excluded or vulnerable people (for example "gamble after self-exclusion").

6.3.3 Misleading claims, including lottery and prediction claims. You must not state or imply that:
(a) winning is likely, guaranteed or "sure", or that a bet is "risk-free";
(b) any number, tip, system, prediction, "hot" or "cold" number, pattern, app or method can increase the chance of winning a lottery-style game or any random draw;
(c) gambling is a skill, an investment, a source of income, a way to get out of debt, a way to win back losses, an alternative to employment, or a path to financial security or to making dreams come true;
(d) the more or longer someone gambles, the more likely they are to win; or
(e) gambling leads to personal, financial or social success.
Prohibited phrases include, for example: "guaranteed win", "100% win", "sure numbers", "can't lose", "fixed numbers", "double your money", "easy money", "quit your job", "get rich", and the same ideas in any South African language. Lottery and number prediction Promoters: you may share past results and general information, but every post that shows numbers or "predictions" must clearly say that draws are random and past results do not affect future results.

6.3.4 False or misleading offers: describe a bonus, promotion or odds inaccurately, leave out its key conditions, or promote gambling as free or discounted as an inducement to gamble. Every bonus you mention must link to the Operator's terms for that bonus.

6.3.5 Spam and unsolicited messages: send any email, SMS, WhatsApp message, Telegram message, direct message, voice note or call to any person who has not given you clear prior consent to receive gambling marketing from you. This includes adding people to WhatsApp or Telegram groups without their consent and bulk-messaging contact lists you bought, scraped or received from others. Every message must identify you and give contact details where the recipient can ask you to stop (POPIA section 69(4)), and you must honour opt-outs immediately. You must comply with POPIA section 69 and CPA section 11. If you send direct marketing by SMS, WhatsApp, email, telephone or any other one-to-one electronic communication, you must also register as a direct marketer on the National Opt-Out Registry administered by the National Consumer Commission, keep that registration current, and check (cleanse) your contact lists against the registry as the regulations require before each campaign. You do not need to register if you only publish posts on your own pages, groups or channels.

6.3.6 Pretending to be an Operator or us: suggest that you are an Operator, its official page or account, its employee or agent, or our official channel. Your pages, groups and accounts must not use an Operator's name, logo or brand as their own name or profile picture, and must clearly say that you are an independent promoter.

6.3.7 Brand keywords and domains: bid on, buy or register any search, social media or app-store keyword, hashtag, ad term or domain name that includes or is confusingly similar to an Operator's or our name or trademarks, including misspellings. You must also not use those names in meta tags or as the name of an app.

6.3.8 Cookie stuffing and technical tricks: use cookie stuffing, forced clicks, pop-unders, hidden iframes, redirects, cloaking, link hijacking, parked domains, adware, browser extensions, bots or any other method that places a Tracking Link or cookie without the user knowingly clicking it.

6.3.9 Incentivised traffic: offer or give any person cash, cashback, a share of your Commission, airtime, data, gifts or any other reward for registering, depositing or betting with an Operator, unless we and the Operator have approved it in writing in advance.

6.3.10 Unlicensed and illegal products: promote, link to or advertise any gambling product or website that is not licensed in South Africa, or any product that an Operator may not lawfully offer in South Africa. In particular:
(a) Online casino games (online slots, live casino, crash games and similar interactive casino games) are not authorised in South Africa under the National Gambling Act (section 11). You must not promote them, even if the Operator's website offers them.
(b) The National Lottery: you must not suggest that any Operator product is the South African National Lottery, is connected to it, or is endorsed by the National Lotteries Commission or the National Lottery operator, and you must not use their names or logos.
(c) Lottery-style betting (such as fixed-odds bets on lottery or number draws, sometimes called "Lucky Numbers"): you may promote it only if the Operator offers it under its South African licence and we have listed it as an approved product in your Commission Schedule. We may remove it from the approved list at any time.
(d) Other products: you may promote any other product only if the Operator offers it under its South African licence and we have listed it as an approved product in your Commission Schedule.

6.3.11 Restricted places and people: target people outside South Africa, or promote in any place where the Operator is not licensed or where gambling advertising is illegal.

6.3.12 Unsuitable content: place Marketing Material on or next to content that is pornographic, violent, hateful, discriminatory, defamatory, illegal, or that promotes piracy, drugs, or self-harm, or use lewd or indecent language or images.

6.3.13 Excessive gambling: show or encourage excessive or irresponsible gambling, chasing losses, gambling under the influence of alcohol or drugs, or gambling with money needed for essentials.

6.3.14 Times and media: advertise at times, in media or in places that Applicable Law, the ARB or the Operator restrict. If new advertising rules (including any rules on influencers, sponsorship or broadcast times) come into force, you must follow them from their start date, even if we have not yet updated these Terms.

6.4 Social media and messaging platforms

6.4.1 You must follow the advertising and community rules of every platform you use (including Facebook, Instagram, TikTok, YouTube, X, Telegram and WhatsApp), including their rules on gambling content, age-gating and paid ads. If a platform requires prior authorisation for gambling ads, you must obtain it before running paid ads.

6.4.2 Facebook pages and groups: you must disclose in the group description or page "about" section that the page or group contains gambling promotions for persons aged 18 or older, and include the warning in clause 6.1. Where the platform allows age restriction, you must set it to 18+.

6.4.3 Telegram and WhatsApp channels and groups: people must join of their own choice (for example through an invite link they click). You must not add people without their consent. The channel or group description must contain the warning in clause 6.1 and an explanation of how to leave.

6.4.4 TikTok, YouTube, Reels and live streams: you must use the platform's tools to label paid partnerships or adverts, and set age restrictions to 18+ where available. You must not show a person under 18 in any gambling-related content.

6.4.5 Disclosure: every post that contains a Tracking Link or promotes an Operator must clearly show that it is an advert, for example by including "#Ad" or "Advert" or using the platform's paid-partnership label.

6.4.6 Your admins and moderators: you are responsible for content posted by any admin or moderator of your pages, groups or channels, and for removing comments by others that break these Terms (for example "guaranteed win" claims) as soon as you become aware of them.

6.5 Approval of Marketing Material

6.5.1 Material that needs approval before use:
(a) any Marketing Material that you create yourself and that uses an Operator's name, logo, bonus or offer;
(b) any paid advertising campaign;
(c) any new website, page, group, channel or account you want to use; and
(d) any content related to lottery-style betting or number predictions.
Submit it through your Promoter Dashboard or to [email protected]. We aim to respond within 3 business days. Material is approved only when we approve it in writing. No reply means no approval.

6.5.2 Material that does not need approval: banners, links and creative that we or the Operator provide through your Promoter Dashboard, used without any change.

6.5.3 Approval does not take away your responsibility to comply with these Terms and Applicable Law. We may withdraw an approval at any time, and you must remove the material within 24 hours of our request.

6.5.4 Records. You must keep a copy of every piece of Marketing Material you publish, with the date, channel and approval reference, for at least 5 years after the agreement ends, and send copies to us within 2 business days of our request.

7. Prohibited Traffic and Fraud

In short: Only real, independent adults who chose to sign up count. Signing up yourself, your family, fake people or bots is fraud.

7.1 You must not, and must not allow anyone else to:
(a) self-refer: open or use a Player account with an Operator through your own Tracking Link for yourself, your employees, your family, your household or anyone acting for you;
(b) create fake or multiple accounts: register Players using false, borrowed or bought identities, or help any Player open more than one account;
(c) bonus abuse: encourage or help Players to abuse bonuses or promotions (for example by matched betting, arbitrage, multi-accounting, or claiming bonuses and immediately withdrawing);
(d) artificial traffic: use bots, scripts, click farms, emulators, VPN or proxy traffic, or any other way to generate clicks, registrations, deposits or bets that do not come from real people acting by their own choice;
(e) collusion: agree with Players or others to share winnings, deposits or Commission, or to manipulate bets;
(f) pay for Players' deposits or bets, or lend money to Players to gamble; or
(g) manipulate tracking: change, mask, shorten (unless we provide the short link), or tamper with Tracking Links or our tracking platform.

7.2 Investigation. If we or an Operator suspect fraud or any activity in clause 7.1, we may hold all your Commission while we investigate (see clause 8.4). You must co-operate fully, including by giving us access to your advertising accounts, traffic data and records.

7.3 Consequences. Commission from any Player connected to fraud is never payable. If it has already been paid, you must repay it. Fraud is always a Serious Breach under clause 8.2, and we may report it to the Operator, the relevant gambling board, the police or other authorities.

8. Violations and Penalties

In short: This is a one-strike programme. Small labelling or approval mistakes get a warning and 5 days to fix them. Any other breach ends the agreement at once: you lose the commission for the month(s) of the breach and from players connected to it, and we may hold your other unpaid commission to cover our losses before paying you the balance. You can appeal any decision.

8.1 Minor Breaches. Only the following are Minor Breaches:
(a) a warning under clause 6.1 is shown, but its size, placement or duration does not meet clause 6.1.2;
(b) a post is missing the advert label required by clause 6.4.5;
(c) you use creative that we have not approved but that is accurate and otherwise complies with these Terms; or
(d) a profile, page, group or channel is missing the independent-promoter disclosure required by clause 6.3.6 or clause 6.4.
For a Minor Breach:

  • first time: we send you a written warning, and you must fix the breach within 5 days of our notice and confirm this in writing;
  • second Minor Breach within 12 months of the first: you lose all Commission for the Month(s) in which the second breach happened; and
  • third Minor Breach within 12 months of the first, or failure to fix any Minor Breach within 5 days: we treat it as a Serious Breach under clause 8.2.

8.2 Serious Breaches — one strike. Every breach of these Terms that is not a Minor Breach is a Serious Breach. This includes, for example: having no warning at all, misleading claims such as "guaranteed win", adding people to groups or messaging them without consent, brand-keyword bidding, promoting online casino games or unlicensed products, targeting minors or Excluded Persons, pretending to be an Operator, fraud under clause 7, and any breach that causes an Operator to penalise or remove us. For a Serious Breach, even a first one:
(a) we end the agreement immediately by written notice;
(b) you lose all Commission for the Month(s) in which the breach happened and all Commission from Players connected to the breach, whether or not it is already payable;
(c) we may hold your other unpaid Commission and set off against it our losses, Operator penalties and costs caused by the breach (clause 12), and we will pay any balance in the next payment run after these are settled; and
(d) we may recover Commission already paid for Players connected to the breach and claim our losses under clause 12.

8.3 Operator penalties pass through. If an Operator imposes a stricter measure on us because of your conduct (for example forfeiting all commission for our account), we may apply a measure of equal effect to you.

8.4 Commission hold and review period. While we investigate a suspected breach or fraud, we may pause your Tracking Links and hold all your Commission. We will tell you in writing which Players or activity are affected and why, unless an Operator or the law prevents us from doing so. We will try to finish our review within 45 days. If an Operator is also investigating, the review may take longer, and we will update you at least every 30 days. If we find no breach, we will release the held Commission in the next payment run.

8.5 Appeal. You may appeal any measure under this clause by emailing [email protected] within 14 days of our notice. Explain why and attach your evidence. A person who was not involved in the original decision will review your appeal and reply within 30 days. If the appeal succeeds, we will reinstate your account (where it was ended) and release the held or forfeited Commission (to the extent the Operator has paid us for it) in the next payment run. If you are still not satisfied, clause 14 applies.

8.6 No waiver. If we decide not to act on a breach, or act later, we may still act on that breach or any later breach.

8.7 Reasonable pre-estimate. You agree that the forfeiture of Commission under this clause is a reasonable pre-estimate of the loss and risk we suffer from breaches, including the risk of losing our relationship with Operators.

9. Intellectual Property and Brand Use

9.1 Licence to you. While the agreement continues, we give you a limited, non-exclusive, non-transferable and revocable right to use the Operators' and our names, logos and creative that we provide, only to promote Operators under these Terms. All of it remains the property of the Operator or us.

9.2 Rules for use. You must follow each Operator's brand guidelines and must not change, distort or combine any logo or creative, or use it in a way that harms the Operator's or our reputation.

9.3 No registrations. You must not register or use any company name, domain, social media handle, page name, app name or trademark that includes or is confusingly similar to an Operator's or our names or trademarks. If you have done so, you must transfer it to us or the Operator on request, at no cost.

9.4 Your content. You keep ownership of your own content. You give us and the Operators a free, non-exclusive right to review, copy and keep it for compliance and record-keeping purposes, and to show approved material to the Operator.

9.5 End of rights. When the agreement ends, or if we ask, you must stop using and delete all Operator and YouBet Partners brand material and Tracking Links within 7 days.

10. Data Protection (POPIA) and Confidentiality

10.1 Your obligations under POPIA. When you collect or use personal information of any person (for example group members, followers or people who message you), you are the responsible party under POPIA and you must comply with it. In particular you must:
(a) have a lawful reason to process the information and, for electronic direct marketing, the person's prior consent (POPIA section 69);
(b) tell people who you are and why you collect their information;
(c) keep the information secure; and
(d) delete it when you no longer need it or when the person asks you to.

10.2 No sharing of Player data. We do not give you Player names, contact details, ID numbers or other personal information. The Promoter Dashboard shows only anonymous or aggregated data. You must not try to identify Players or ask Operators for their data.

10.3 Your information. We process your personal information (for example your ID, contact and payment details) to run the Programme, pay you, carry out KYC and fraud checks, and meet our legal and Operator obligations. We may share it with Operators, our tracking and payment providers, our professional advisers, and authorities where the law requires. Our privacy notice at https://www.youbetaff.com/legal/privacy/ explains this in more detail and how to exercise your rights.

10.4 Data incidents. If you become aware that personal information connected with the Programme has been lost, stolen or accessed without permission, you must tell us within 72 hours.

10.5 Confidentiality. You must keep confidential, and use only for the Programme, any non-public information you receive from us or an Operator, including your Commission rates, Commission Schedule, Operator Terms, statements, creative before launch and the contents of any dispute. This duty continues for 2 years after the agreement ends. It does not apply to information that is public through no fault of yours, or that the law requires you to disclose.

11. Term and Termination

11.1 Term. The agreement starts on the date in clause 2.1 and continues until either party ends it.

11.2 Ending for any reason. Either party may end the agreement for any reason by giving the other 14 days' written notice (email is enough).

11.3 Immediate termination by us. We may end the agreement immediately by written notice if:
(a) you commit a Serious Breach (clause 8.2);
(b) you give us false information, or fail our KYC checks;
(c) an Operator requires us to remove you, or our agreement with the relevant Operator ends (in that case only the part relating to that Operator ends, unless no Operators remain);
(d) a change in Applicable Law, or an instruction from a regulator, makes it unlawful or impractical for us to continue; or
(e) you become insolvent or are placed under business rescue or sequestration, or (for a company) there is a change in who controls you without our prior consent.

11.4 What happens when the agreement ends.
(a) You must immediately stop promoting Operators, and within 7 days remove all Tracking Links and brand material (clause 9.5).
(b) If the agreement ends under clause 11.2 or 11.3(c) or (d): we will pay you Commission earned up to the end date, to the extent covered by Operator Payments, in the normal payment runs, provided you are not in breach. No Commission is payable for any period after the end date, including for Players you referred before it.
(c) If the agreement ends under clause 11.3(a) or (b) or because of a Serious Breach: clause 8.2 applies. Giving us false information or failing our KYC checks is a Serious Breach.
(d) If the agreement ends under clause 11.3(e): clause 11.4(b) applies, less any amounts you owe us.
(e) If your final balance is below the minimum payment amount, clause 5.5 applies.

11.5 Clauses that survive. Clauses 4.4, 5.5, 5.8–5.12, 6.5.4, 7.3, 8, 9.3, 10, 12, 14 and any other clauses that by their nature should continue, continue after the agreement ends.

12. Limitation of Liability and Indemnity

12.1 What we do not promise. We provide the Programme and tracking platform "as is". We do not promise that tracking will be uninterrupted or error-free, that any Operator will remain in the Programme, or that you will earn any particular amount.

12.2 Limits on our liability. To the extent the law allows:
(a) we are not liable for any indirect or consequential loss, or for loss of profit, income, data or goodwill;
(b) we are not liable for any loss caused by an Operator, by our tracking or payment providers, or by events beyond our reasonable control; and
(c) our total liability to you for all claims in any 12-month period is limited to the total Commission we paid you in the 12 months before the claim arose.
Nothing in these Terms limits liability for fraud, or for gross negligence or deliberate wrongdoing where the law does not allow it to be limited.

12.3 Your indemnity. You must compensate us, our directors and staff, and (where we are liable to them) the Operators, for all losses, fines, penalties, claims, Operator clawbacks and reasonable legal costs arising from:
(a) your breach of these Terms or of Operator Terms;
(b) your breach of Applicable Law, including advertising, data protection and consumer laws;
(c) your Marketing Material, websites, pages, groups or channels; and
(d) the conduct of your employees, admins or anyone acting for you.

12.4 We may deduct amounts due under clause 12.3 from your Commission (clause 5.11).

13. Changes to these Terms

13.1 General changes. We may change these Terms, the Commission Schedule or the Programme rules by giving you at least 14 days' notice by email and in your Promoter Dashboard.

13.2 Urgent changes. We may make changes with shorter notice, or with immediate effect, if they are required by Applicable Law, a regulator or an Operator, or are needed to prevent fraud. We will tell you as soon as possible.

13.3 Your choice. If you do not agree to a change, you may end the agreement by notifying us before the change takes effect. Commission earned until then will be paid under clause 11.4(b). If you continue in the Programme after the change takes effect, you accept the changed Terms.

13.4 Rate changes. A reduction in your rates applies only to Players referred after the change, unless the Operator has reduced the rate it pays us (clause 4.4(d)).

14. Governing Law and Dispute Resolution

14.1 Law. These Terms are governed by the laws of the Republic of South Africa.

14.2 Talk first. If there is a dispute, either party may send a written notice describing it. Both parties must try in good faith to settle it within 30 days of the notice, including through the appeal process in clause 8.5 where it applies.

14.3 Courts. If the dispute is not settled within that time, the courts of the Republic of South Africa have exclusive jurisdiction to decide it.

14.4 Urgent relief. Nothing in this clause stops either party from asking a competent court for urgent relief, such as an interdict to stop misuse of a brand or unlawful marketing.

15. General

15.1 Entire agreement. These Terms, the Commission Schedule, the Operator Terms made available to you, and any written approvals or special agreements we sign with you make up the whole agreement between us.

15.2 Order of priority. If documents conflict, this order applies: (1) a special written agreement signed by both parties; (2) the Operator Terms, where they are stricter (clause 4.1); (3) the Commission Schedule; (4) these Terms.

15.3 Transfer. You may not transfer your rights or duties under these Terms. We may transfer ours to a related company or to a buyer of our business by giving you notice.

15.4 Notices. We send notices to the email address in your account. You send notices to [email protected]. An email is treated as received on the next business day after it was sent, unless the sender receives a delivery failure message. For the purposes of the ECT Act, our address for legal documents is the registered address in clause 1.1; until we publish that address, it is [email protected].

15.5 Severability. If any part of these Terms is found to be unenforceable, the rest remains in force.

15.6 Language. These Terms are in English. If we provide a translation, the English version prevails.
