Prohibited practices

  • Promoting unauthorised lotteries

Promoting a lottery that is not authorised by law is an offence (Lotteries Act s57(1)).

  • Betting on lottery results

Promoting any scheme that offers betting on lottery results is an offence unless authorised by law (Lotteries Act s57(2)(g)). We approve them in your Commission Schedule only when the operator offers them under its South African licence, and only after legal confirmation.

  • Offshore lotteries

Running a lottery wholly or partly outside South Africa is not a defence for conduct in South Africa (Lotteries Act s59). We do not accept offshore lottery resellers.

  • Prediction competitions with prizes

Competitions that award prizes for predicting future results through newspapers, radio or any electronic device need authorisation (Lotteries Act s56). Prediction competitions with prizes are not allowed.

  • Unlicensed interactive games

Interactive games may only be offered under a licence issued under the National Gambling Act (NGA s11). Online casino is outside our business.

  • Misleading or under-18 advertising

No false or misleading advertising, and no advertising aimed at, or attractive to, minors (NGA s15).

  • Messages without consent

Direct marketing by electronic communication is prohibited without consent, unless the person is an existing customer (POPIA s69).

  • No brand keyword bidding or look-alike domains

Our Affiliate terms prohibit bidding on brand keywords and registering domains that include or are confusingly similar to an operator's or our name (clause 6.3.7).

Penalties

A conviction under the Lotteries Act can lead to a fine, imprisonment or both (s62).
